# EU GDPR for AI Voice and Chat in 2026 — DPIA, ROPA, and Article 22

> The GDPR did not need to be rewritten for AI voice and chat — it just needed to be applied. The EDPB's 2024 ChatGPT Taskforce report and Opinion 28/2024 on AI models did exactly that, and the 2026 Joint Opinions on the Digital Omnibus closed the remaining gaps.

## What the law says

Regulation (EU) 2016/679 (GDPR) governs every voice or chat agent that processes EU residents' personal data. Article 5 sets the principles — lawfulness, fairness, transparency, purpose limitation, data minimisation, accuracy, storage limitation, integrity, accountability. Article 6 requires a valid lawful basis for every processing operation. Article 9 layers consent or another narrow exception over special-category data — voice biometrics, health, and inferred attributes such as ethnicity or sexual orientation often qualify. Articles 13 and 14 demand at-collection notice. Article 22 restricts decisions based solely on automated processing that produce legal or similarly significant effects. Article 30 requires a record of processing activities (ROPA). Article 35 mandates a data protection impact assessment (DPIA) where processing is likely to produce a high risk, which the EDPB lists include systematic monitoring, large-scale processing of special-category data, and the use of new technologies — voice AI clears all three.

The EDPB's Opinion 28/2024 confirms that legitimate interests (Art. 6(1)(f)) can justify training and deployment only after a documented three-step balancing test, and that personal data unlawfully scraped during training infects downstream deployment unless the model is genuinely anonymous. The May 2024 ChatGPT Taskforce report adds that responsibility for fairness cannot be shifted to users via terms of service. The February 2026 EDPB-EDPS Joint Opinion 02/2026 on the Digital Omnibus reasserts that GDPR core principles continue to apply alongside the AI Act, not below it.

## What AI voice/chat must do

Map every processing operation to a lawful basis before launch — a single "consent" cannot cover account creation, training, analytics, and marketing. Publish layered Article 13 notices so the caller hears a short version on the line and can read a full version on the website. Treat voice biometrics as Article 9 special-category data unless you can prove the agent does not extract speaker-identification features. Run an Article 35 DPIA before deployment and keep it living: re-run on prompt changes, model swaps, new tool integrations, or new data sinks. Avoid Article 22 "solely automated" outcomes for any decision that produces legal or significant effects (loan, insurance, hiring, eligibility) — wire in meaningful human review, not rubber-stamping. Maintain a ROPA per Article 30 that names the agent, purposes, categories, recipients, retention, and cross-border transfers. Route all transfers outside the EEA through Article 46 safeguards (SCCs plus a TIA, or BCRs).

## Compliance checklist

1. Inventory every processing operation in the voice/chat lifecycle and map it to an Article 6 lawful basis plus an Article 9 condition where special-category data is in scope.
2. Run an Article 35 DPIA before launch and re-run on every material change.
3. Maintain an Article 30 ROPA in plain language; name controllers, processors, and sub-processors.
4. Publish layered Article 13 notices in every deployer language; train the agent to deliver the short notice on turn one.
5. Identify any Article 22 solely-automated decisions and either remove them or insert meaningful human review.

10. Log every inference and tool call so the supervisory authority can trace a decision end-to-end.

## FAQ

**Is consent the right basis for AI voice agents?**
Rarely for the whole stack. Consent works for marketing add-ons; the contract or legitimate-interests basis usually carries the core service.

**Does Article 22 ban AI scheduling and triage?**
No — Article 22 restricts solely automated decisions with legal or significant effects. Scheduling rarely meets that bar. Eligibility and triage often do; insert human review.

**Are voice recordings always special-category data?**
Recordings can contain Article 9 inferences (health, ethnicity). Voice biometrics for identification are Article 9. Record only what you need and minimise retention.

**Can we use US-hosted models for EU callers?**
Yes, with SCCs, a TIA, and supplementary measures. Region-pinned EU hosting reduces TIA work and is the simpler path.

**What is the DPIA threshold for chatbots?**
